The petitioner is allottee of EWS House No.320, Sector 20, Part-II, Panchkula. His grievance is against the Notice dated 14.01.2016 said to have been served on him 24.05.2018 asking him to pay additional price of `84,426/- for the said dwelling unit on the ground of enhancement of compensation for the acquired land. In fact, the impugned Notice refers to various judgments passed by Additional District Judge upto Hon'ble Supreme Court on the basis of which the revised allotment price has been demanded. The petitioner has multiple grievances against the enhancement in allotment price, especially against the interest component. It appears that the petitioner as well as the Residents Welfare Association have represented the HUDA authorities against the impugned demand. Since the issue sought to be raised in the instant writ petition is essentially a question of fact which can be determined by the authorities on verification of record, the writ petition is disposed of at this stage without Meenu 2018.07.03 16:19 I attest to the accuracy and authenticity of this document chandigarh

CWP-15819-2018 -2expressing any views on merits with a direction to the Estate Officer, HUDA, Panchkula to consider the representation said to have been submitted by the petitioner or other allottee(s) against the impugned Notice and decide the same by way of a reasoned order as early as possible but not later than two months from the date of receipt of a certified copy of this order. We are further informed that meanwhile 'One Time Settlement' Scheme has been notified by the State Government/HUDA under which such like dues can be deposited at a concessional rate. The petitioner or other allottees may avail the benefit of OTS Scheme without prejudice to their legal rights against the impugned action.
