KARAMJIT SINGH , J. (Oral) The case has been taken up through Video Conferencing due to prevailing situation of COVID-19.

Learned State counsel made request that the petitioner is lodged in Central Jail, Patiala, and his village is situated in District Sonepat and as such, the State authorities failed to verify the factum of the marriage of the petitioner, which is alleged to be performed on 24.10.2020 in the area of District Bhiwani, The said statement was made by the learned State counsel on the instructions of SI Paramjit Singh, P.S. Sohana, District S.A.S. Nagar (Mohali),. The copy of invitation card of the marriage is already there on the record. The copy of information sent by Sarpanch of the village of the petitioner to SHO of concerned police station with regard to the aforesaid marriage, which is fixed for 24.10.2020, is also there on the record. The copy of information sent by Sarpanch of the village of the in-laws of the petitioner is also produced by the counsel for the petitioner, as per which, petitioner is getting married with Deepti daughter of Pawan Kumar on 24.10.2020 in village Tigrana, District Bhiwani.

CRM-M-33920-2020 -2No doubt the assistance of the respondent was sought by this Court on the last date of hearing to verify the contents of the petition, but the State failed to do so except for providing information that the petitioner is a gangster and is facing trial in number of criminal cases. As this petition is involving the marriage of the petitioner himself, which is stated to be performed on 24.10.2020, the same is hereby disposed of in the interest of justice with a direction to the police authorities of District Patiala to take the petitioner in custody under the proper escort to village Tigrana, District Bhiwani at about 10:00 a.m on 24.10.2020 and take him back to Central Jail, Patiala, under proper escort, immediately on the completion of his marriage ceremony with Deepti.

The proper care be taken by the police officials escorting the petitioner, so that no untoward incident happens during his marriage ceremony in village Tigrana, District Bhiwani. The police officials of the District Patiala should also take the assistance of the local police of District Bhiwani to avoid any such untoward incident. The copy of this order be immediately sent to the Senior Superintendent of Police, Patiala and Superintendent of Central Jail, Patiala to do the needful. All the travelling expenses are to be borne by the petitioner or his family including that of the police escort. A copy of this order be given to the learned counsel for the petitioner under the signatures of the Bench Secretary/Superintendent of this Court.
