Instant petition has been filed under Article 226 of the Constitution of India read with the Punjab Good Conduct Prisoners (Temporary Release) Act, 1962 for issuance of a writ in the nature of mandamus directing the respondents to release the petitioner on parole for eight weeks for repairing his house and to look after his aged mother. Upon instructions from Shiv Raj Singh, Superintendent Central Jail, Patiala, State counsel submits that application seeking parole (Annexure P-1) has never been submitted by the petitioner. Faced with this situation, counsel for the petitioner seeks and is granted permission to withdraw the petition.
