IN THE HIGH COURT OF PUNJAB AND HARYANA AT CHANDIGARH
CWP No.17607 of 2017 (O&M) Date of decision:18.08.2017 Suresh Pal
...Petitioner
Versus
Deputy Commissioner-cum-District Magistrate and another ...Respondents Coram:
Hon'ble Mr. Justice Rakesh Kumar Jain
Present:
Mr. Rajbir Singh Guron, Advocate, for the petitioner.
***** Rakesh Kumar Jain, J.
The petitioner is the son of respondent no.2 who has challenged the order dated 01.06.2017 passed by the Deputy Commissioner, Chandigarh under the provisions of the Maintenance and Welfare of Parents and Senior Citizens Act, 2007, by which the petitioner has been directed to vacate first floor of House No.1830, Sector 38-West, Daddu Majra Colony, Chandigarh as well as his shop situated in the Main Market of village Maloya, near Gurudwara, Chandigarh, within 30 days from the date of receipt of the order. The basic argument raised by counsel for the petitioner is that he is occupying the shop in question as a tenant. However, he could not produce any evidence to this effect showing the relationship of landlord and tenant between him and respondent no.2 except that he is in occupation thereof. No other point has been raised.
In view thereof, I do not find any merit in the present petition and hence, the same is hereby dismissed, though without any order as to costs. August 18, 2017 (Rakesh Kumar Jain) vinod* Judge Whether speaking/reasoned :
