HARINDER SINGH SIDHU, J Prayer in the instant petition filed under Section 439 Cr.P.C is for extension of interim bail granted to the petitioner vide order dated 09.11.2020.

The petitioner is accused in case FIR No.199 dated 24.07.2020 under Section 22 of the NDPS Act registered at P.S City Rupnagar, District Rupnagar.

As per allegations, 80 injections of Buprenorphine Hydrochloride and 80 injections of Avil were recovered from the possession of the petitioner as well as his accomplice.

Vide order dated 09.11.2020, the petitioner was directed to be released on interim bail as FSL report had not been received. It was directed that the petitioner would submit an undertaking before the trial Court that he would surrender on receipt of FSL report. Learned counsel for the petitioner submits that the petitioner could not surrender in terms of directions contained in the order as he was unwell.
