(ORAL) The petitioner has challenged the Agenda Item No.4 circulated vide letter dated 27.10.2014 (Annexure P-18) for the meeting of the Board of Directors to be held on 12.11.2014.

In response to the query of this Court whether any decision had been taken in the afore-noted meeting, learned counsel for the parties are ad idem that no further action has been taken on the agenda item No.4 which is impugned in this petition.

Learned counsel for the petitioner submits that the petitioner is entitled to promotion as a Centrifugal Mechanic. He further submits that the petition may be disposed of with a direction to respondent No.2 to consider the case of the petitioner and other eligible candidates. Without making any observations on the merits of the case, the petition is disposed of with a direction to respondent No.2 to consider the case of the petitioner and other eligible candidates including respondent No.5 and pass a speaking order within a period of four months. In the event of the petitioner having any objection about the eligibility of respondent No.5, he would raise the same before respondent No.2.

The petition stands disposed of accordingly.
