The petitioner through instant petition under Articles 226/227 of Constitution of India is seeking direction to respondents to re-issue his passport which is valid upto 20.03.2026. 2.

Learned counsel for the petitioner inter alia contends that petitioner was issued passport on 21.03.2016 which is valid upto 20.3.2026. The petitioner on account of his business frequently travels to abroad. The petitioner during March' 2022 to February' 2023 has travelled abroad more than ten times. On account of regular visits, the pages in the passport have exhausted, thus, petitioner applied for reissuance of passport, however, passport authority has rejected application on the ground that criminal proceedings are pending against the petitioner. CWP-14736 of 2023 -2- 2023:PHHC:098119 The petitioner every time visited abroad after getting prior permission of the trial court. As trial court has granted permission, thus, case of the petitioner is squarely covered by Notification No. 570 dated 25.08.1993. 3.

Ms. Saigeets Srivastava, learned counsel for Union of India, who on advance notice is present in Court, submits that petitioner may appear before the passport authority and his case would be reconsidered. 4.

In view of statement of learned counsel for Union of India and considering the fact that after getting permission from trial court, the petitioner has travelled abroad couple of times, the present petition stands disposed of with a direction to petitioner to appear before passport authority on 28.08.2023. The passport authority would do the needful expeditiously and preferably within four weeks thereafter.
