The instant petition has been filed under Section 528 of Bharatiya Nagarik Suraksha Sanhita, 2023, seeking appropriate directions to respondent No.4 to refrain from interfering in the free plying of the vehicle of the petitioner bearing registration HR-45-E-8428, in light of the judgment of the Hon'ble Supreme Court titled as ICICI Bank Ltd. Vs. Parkash Kaur and others, RCR Criminal 2007(2) 76. Alternatively, further direction has also been sought to respondent Nos.2 and 3 to take appropriate action against respondent No.4-Bank, as the said respondentBank is not allowing the petitioner to ply his vehicle freely for his transport business.

On the strength of advance copy of the petition, learned State counsel submits that the grievance of the petitioner shall be looked into by the concerned authority/respondent No.2 and a decision on the application/representation dated 6.5.2026 (Annexure P-3) shall be taken, in accordance with law.

Without commenting on the merits of the case and considering the relief sought, the instant petition is disposed of with a direction to respondent No.2-Superintendent of Police, Karnal, to look into the application/representation dated 6.5.2026 (Annexure P-3) of the petitioner and take appropriate action, if and as required, in accordance with law, preferably within a period of 2 weeks from the date of receipt/ production of certified copy of this order and the same be communicated to the petitioner thereafter.
