**** HARSIMRAN SINGH SETHI J. (Oral) The present petition has been filed with a prayer that the petitioner, who is already on parole vide order dated 25.06.2021 and required to surrender on 19.09.2021, be allowed further extension of the parole for a period of another three months, keeping in view the fact that the wife of the petitioner is in such a medical condition that she cannot be left alone and requires the company of the petitioner as she is not in a medically stable condition.

Learned counsel for the petitioner submits that it is only due to the medical urgency under which the wife of the petitioner is at the present moment, the extension of parole, is being prayed for and apart for the said reason petitioner has no hesitation to surrender on the date already fixed.

Learned counsel for the petitioner further submits that a prayer has already been made for the extension of the parole by filing a representation (Annexure A-3) dated 15.09.2021 to the Superintendent

-2Central Jail, Kapurthala, which is already under consideration. Notice of motion.

Mr. Sandeep Kumar, D.A.G, Punjab, who is present in the Court accepts notice for respondent-State.

Learned counsel for the respondent submits that as per his instructions, there is no provision for extension of the parole already granted, but, in case a convict surrenders, and thereafter needs parole to attend an ailing relative, the said request can be considered by the authority.

Learned counsel for the petitioner submits that the petitioner has already filed the representation dated 15.09.2021 (Annexure A-3), which may kindly be decided by the jail authorities in a shortest possible period so that, the petitioner is able attend his ailing wife.

Learned counsel for the respondent submits that the request of the petitioner addressed to Superintendent Central Jail, Kapurthala dated 15.09.2021 (Annexure A-3), will be decided by the competent authority taking compassionate view, within a period of 7 days from today.

Learned counsel for the petitioner submits that keeping in view the undertaking given by learned State counsel for considering his prayer for grant of parole by passing appropriate speaking order, he does not press this petition any further and the petitioner will surrender to the jail authority on the date already fixed in pursuance to the parole granted to the petitioner vide order dated 25.06.2021 but petitioner be given liberty to avail appropriate remedy in case he is aggrieved in any

-3manner in respect of the order to be passed in pursuance to the under taking recorded herein before.

Order accordingly.
