Sonu And Another v. State Of Haryana And Others
IN THE HIGH COURT OF PUNJAB AND HARYANA AT
CHANDIGARH Date of Decision:- 16th August,2022 Sonu and another ......Petitioners
Versus
State of Haryana and others ........Respondents CORAM:- HON'BLE MS. JUSTICE NIDHI GUPTA Present:- Mr. Naveen Siwach, Advocate for the petitioners ****** NIDHI GUPTA, J. (ORAL) As per copies of Aadhar Cards (Annexure P-1 and P-2), petitioner no.1 (man) is aged 28 years, whereas petitioner no.2 (woman) is aged about 26 years. It is stated that the petitioners are residing in a live-in relationship with each other with their free consent and will and without any pressure. Apprehending threat to their life and liberty, they have filed the present petition for protection. Petitioners claim to have submitted a representation dated 6.8.2022 (Annexure P-3) in this regard to the Superintendent of Police, Hisar, District Hisar.
Heard.
Record perused.
Learned counsel for the petitioners has submitted that petitioner no.2 (woman) was married to respondent no.4 and out of that wedlock one son was also born. However, having fallen in love with petitioner no.1, petitioner no.2 left her matrimonial home and started living with petitioner no.1 in a live-in relationship. It is stated that son of petitioner no.2 is residing with respondent no.4. It is further submitted that since the private respondents are threatening the petitioners to face dire consequences, therefore, necessary protection to their lives be provided.
Earlier petitioners filed CRWP 7529 of 2022 before this Court which was dismissed as withdrawn vide order dated 6.8.2022. In the present matter vide order dated 10.8.2022 this Court directed that case file of CRWP 7529 of 2022 be tagged along with the present case.
A perusal of CRWP 7529 of 2022 shows that it was on the same cause of action and seeking same relief as in the present matter. When questioned as to why said petition was withdrawn, learned counsel for the petitioners stated that in CRWP 7529 of 2022 representation seeking protection was filed before Superintendent of Police, Sonipat, District Sonipat. However, as the petitioners reside in Hisar, therefore, it is more appropriate to file representation seeking protection before Superintendent of Police, Hisar, District Hisar. As stated above, petitioners have already filed said representation dated 6.8.2022 (Annexure P-3) before Superintendent
of Police, Hisar.
Notice of motion to the office of Advocate General, Haryana.
At the asking of the Court, Mr. Vishal Malik, Deputy Advocate General, Haryana, who is present in Court, accepts notice. This Court does not wish to make any observation with regard to the validity of inter se relationship between the petitioners. However, since both of them are adults and stated to be residing in a live-in relationship, the scope of the present petition only pertains to protection of their lives.
Accordingly, this petition is disposed of with a direction to respondent no.2- Superintendent of Police, Hisar, District Hisar that representation of the petitioners, if any, seeking protection of life and liberty be considered and looked into; contents thereof be duly verified; threat perception be assessed and thereafter requisite steps be taken strictly in accordance with law for protection of life and liberty of the petitioners.
