(ORAL) Learned counsel for the parties are ad idem that the matter in issue is squarely covered by the order and judgment dated 8.3.2010, rendered by this Court in the case of State of Haryana and others v. Subhash Chander and others (RFA No. 1226 of 2007), vide which this Court had affirmed the compensation assessed and awarded by the Reference Court, at the rate of Rs. 186.23 paise per square yard by applying twelve per cent increase per annum, and consequently dismissed the State appeals as also the cross-objections. However, as in the matter in hand the Reference Court had already granted compensation at the same rate, i.e. Rs. 186.23 paise per square yard, prayer for further enhancement in the compensation is not feasible, therefore, it is submitted that the appeal be dismissed as such.

Ordered accordingly.
