In the present petition, the challenge is to impugned order dated 18.05.2026 (Annexure P-4) whereby the nomination papers filed by the petitioner to contest the election to the post of Municipal Council, Jaitu, Ward No.14 has been rejected by the respondents.

After arguing for sometime, learned counsel for the parties agree that keeping in view the provisions of the Punjab State Election Commission Act, 1994, in case any nomination form so filed has been rejected on the basis of some typographical error/clerical mistake, the same can be rectified by giving a due chance to the candidate concerned. Hence, the petitioner intends to approach the Deputy Commissioner concerned of the area to allow him/her to rectify any typographical error/clerical mistake in case the nomination paper has been rejected on such ground.

CWP-15932-2026 respondent-State and Mr. Ayush Sarna, Advocate accepts notice on behalf of State Election Commission, Punjab and submit that in case any representation is reduced into writing and submitted then within a period of 24 hours, the same will be decided in accordance with law by the Deputy Commissioner concerned by passing an appropriate speaking order. Learned counsel further submits that in case, it is found feasible to accept the claim of the petitioner, the same will be accepted, otherwise due reasons for not accepting the claim of the petitioner will be mentioned in the speaking order to be passed and the said order will be duly conveyed to the petitioner.

Learned counsel for the petitioner submits that keeping in view the statement of learned counsel for the respondent-State, the present petition may kindly be disposed of having been not pressed any further with liberty to file an appropriate representation to the Deputy Commissioner concerned. 6.
