G.S.SANDHAWALIA, J. (Oral) The petitioner seeks direction in the nature of mandamus for release of family pension on account of the death of her husband namely Harbans Singh, who was employed as Head Warder alongwith interest. It is the case of the petitioner that her husband retired on 31.08.2012 after putting in service of 31 years 05 months 24 days and started receiving pension. He expired on 29.12.2014 leaving behind his legal heirs and had duly nominated the petitioner as the beneficiary for family pension. However, in spite of various requests made, the family pension has not been credited in the account of the petitioner. Counsel for the petitioner submits that the delay is also on part of respondent no. 1bank. He submits that legal notice dated 20.05.2015 (Annexure P-2) had been served upon the respondents but in spite of that the necessary relief has been denied.

Keeping in view the limited controversy, this Court does not feel necessary to call upon the respondent to file reply. Accordingly, the writ petition is disposed of with a direction to respondent nos. 1 and 2 to take into consideration the legal notice dated 20.05.2015 (Annexure P-2) and decide the same within a period of 4 weeks from the date of receipt of certified copy of the order. In case there is any legal hitch in the grant of family pension, the decision be communicated to the petitioner within the aforesaid period, otherwise the necessary benefits be disbursed forthwith.
