On our asking, Mr.Rajesh Bhardwaj, learned Additional Advocate General, Punjab, accepts notice on behalf of the respondents. Let four copies of the writ petition be supplied to learned State counsel during the course of day failing which this order shall be automatically recalled and the writ petition shall be deemed to have been dismissed for non-prosecution.
In view of the nature of order which we propose to pass, it is not necessary to seek any counter-reply from the respondents at this stage. The petitioners are residents of village Darkuan Bangla, Tehsil Dhar Kalan, District Pathankot. Their land was acquired vide Award dated 25.05.1998 for the public purpose of Reservoir of Ranjit Sagar Dam. CWP No.21306 of 2016 [2] Act, 1894 on 29.09.1998, 30.09.1998 and 06.10.1998. There were in all 44 References filed by different land-owners. It is alleged that the Land Acquisition Collector is sitting over those References and have not forwarded the same to the Court of competent jurisdiction. A direction is accordingly prayed for. It is also specifically averred that the References were filed by the petitioners within the prescribed period. Having heard learned counsel for the parties and considering the nature of relief sought in this writ petition, we dispose of the same with a direction to the Land Acquisition Collector-respondent No.4 to verify the facts and if the References filed in the year 1998 are still lying with him, let the same be forwarded to the Court of competent jurisdiction within a period of two months from the date of receiving a certified copy of this order.
Ordered accordingly.
