CRM-M-34079-2020 This is a petition under Section 438 Cr.P.C. for grant of anticipatory bail in case FIR No. 110 dated 07.9.2020 under Sections 452, 323, 506, 34 IPC (Section 308 IPC was added later on) registered at Police Station Badali Alla Singh, District Fatehgarh Sahib. Learned counsel for the petitioner submits that the injuries inflicted to all the three injured are quite similar and on the same parts of the body which creates doubt that these are the self-inflicted injuries. He further submits that co-accused, who have also been attributed five injuries on the vital parts, have already been granted anticipatory bail by this Court, GURPREET SINGH 2021.03.18 12:42 I attest to the accuracy and integrity of this document Chadigarh

CRM-M No. 34079 of 2020 (O&M) -2whereas as per Annexure R-3, which is General Diary Details, the injuries attributed to the petitioner are under Section 325 IPC. On the other hand, learned State counsel as well as counsel for the complainant submits that four injuries have been attributed to the petitioner and that too on the left eye, right eye, forehead, head and nose of injured Gurjit Singh and petitioner is the main accused. I have heard the learned counsel for the parties. In the present case, as per the prosecution version, the petitioner, in connivance with other co-accused, have inflicted injuries to the complainant, his father and brother. In the present FIR, there are specific allegation against the petitioner that he gave rod blows on the forehead, head, eyes and nose of injured Gurjit Singh.

As per CT scan report (Annexure R-1), there is linear undisplaced fracture of left frontal bone with underlying extra dural hemorrhage of maximum thickness approximately 15 cm. Moreover, the injury inflicted on the left eye of injured Gurjit Singh has been also declared grievous in nature. The petitioner had caused injuries on the head, forehead, eyes and nose of injured-Gurjit Singh, brother of the complainant, which are on the vital parts of the body. Keeping in view the seriousness of allegations against the petitioner, no ground for grant of anticipatory bail to him is made out. The petition is dismissed.
