(Oral) The petitioner, who is working as a Junior Engineer, seeks the decision on his legal notice dated 30.06.2014 (Annexure P-11) whereby, he has sought the benefit of the pay scale of 120-250 w.e.f. 01.01.1968, 450700 w.e.f. 01.01.1978, 1200-2100 w.e.f. 01.01.1986 and 4020-6200 w.e.f. 01.01.1996 and `7480 w.e.f. 01.01.2006 with pay band of `2400. The relief claimed is stated to be on the basis of the notifications issued by the State Government and on account of the petitioner having matric qualification plus ITI course of one year to his credit.
It is the case of the petitioner that his case is covered by the judgment of this Court in CWP No. 10759 of 1990, Rajender Paul Gautam and others vs. State of Punjab and others decided on 30.05.2008 (Annexure P-4), which has further been upheld by the Division Bench on 15.02.2010 and the Apex Court on 12.07.2010 (Annexures P-5 and P-6). He submits that he would be satisfied at this stage if a time bound direction is given to the respondents to decide the legal notice dated 30.06.2014 (Annexure P-11) within a time bound frame. Keeping in view the limited relief sought, this Court does not feel necessary to call upon the respondents to file reply. Accordingly, the writ petition is disposed of with a direction to respondent no. 2 to take into consideration the legal notice dated 30.06.
2014 (Annexure P-11) and decide the same within a period of 3 months from the date of receipt of certified copy of the order. Needless to say if the relief is to be denied, the order shall contain reasons. 16.10.2015 (G.S. SANDHAWALIA) shivani JUDGE SHIVANI GUPTA 2015.10.
