The petitioner has approached this Court seeking grant of regular bail in respect of a case registered vide FIR No.490 dated 7.5.2018 at Police Station Sadar Karnal, District Karnal under Sections 20 and 25 of Narcotic Drugs and Psychotropic Substances Act and Sections 406 and 420 of Indian Penal Code.

Short reply by way of affidavit of Sh. Sher Singh, Superintendent of Prison, District Prison, Karnal has been filed by learned State counsel today in Court, which is taken on record.

The case of the prosecution is that the petitioner alongwith co-accused namely Amit Kumar and Ashok Kumar was found in possession of 45 PANKAJ KAKKAR 2020.01.16 17:08 I attest to the accuracy and integrity of this document

( 2 ) CRM-M-30523-2019 (O&M) kilograms of 'Ganja Patti'. Upon chemical analysis by FSL, the same has been opined to be 'Ganja'.

It is not disputed that the co-accused namely Ashok Kumar and Amit Kumar have since been granted bail by this Court.

The learned State counsel has has informed that the petitioner, as of now, has been behind bars since the last one year and seven months and that till date only 6 out of 23 cited PWs have been examined. 6.

Keeping in view the aforestated facts and circumstances especially the fact that identically situated co-accused have already been granted the concession of bail, the petitioner deserves the concession of bail on grounds of parity keeping in view the fact that conclusion of trial is likely to take some time as a number of PWs still remain to be examined.
