IN THE HIGH COURT OF PUNJAB AND HARYANA AT CHANDIGARH
CRM-M-36192-2022 (O & M) Date of decision: 23.08.2022 Jaiveer @ Monu ...... Petitioner V/s State of Haryana
...Respondent
CORAM:
HON'BLE MR. JUSTICE JASJIT SINGH BEDI
Present:
Mr. Ajay Singh, Advocate, for the petitioner. Mr. Saurabh Girdhar, AAG, Haryana.
***** JASJIT SINGH BEDI, J. (Oral) The prayer in the present petition under Section 439 Cr.P.C. is for the grant of regular bail to the petitioner in case FIR No.364 dated 24.08.2016 under Sections 395/120-B IPC and Section 25 of the Arms Act, registered with Police Station Rajendra Park, District Gurugram. The learned counsel for the petitioner has vehemently argued that no offence is made out as no recovery has been effected from the petitioner and the co-accused of the petitioner has been granted the concession of bail. He further submits that no TIP was conducted in the present case and the petitioner is in custody since 07.04.2022. The learned State counsel, on the other hand, contends that all the prosecution witnesses have been examined and the case is now fixed for recording of statement of the accused under Section 313 Cr.P.C. In view of the above, I see no ground to grant the concession of bail to the petitioner. Dismissed.
