The Civil Revision has been filed under Article 227 of the Constitution of India for issuance of appropriate order or direction for quashing the orders dated 17.05.2023 (Annexure P-7) and 01.07.2023 (Annexure P-8) passed by learned Additional Civil Judge (Senior Division), Mukerian, and in view of these orders, this Court has passed an order dated 19.12.2023, which is reproduced as under:- "On the last date of hearing i.e. 25.08.2023, the following order was passed by this Court:- "Mr. Rahul Jaswal, Advocate has caused appearance on behalf of respondent No.1 and filed his power of attorney which is taken on record.

Learned counsel for respondent No.1 submits that the instant petition has been rendered infructuous as the execution petition itself has been withdrawn. He placed on record copy of the order dated 14.07.2023 to this effect and the same is taken on record.

Learned counsel for the petitioner seeks an adjournment to verify the same.

Adjourned to 19.12.2023."

Counsel for the petitioner has not been able to dispute the fact that the execution petition itself has been withdrawn being satisfied and seeks some time to address arguments.

Today, there is no representation on behalf of the petitioner. 3.

On 19.12.2023, both the counsels for the parties were ad idem that the execution petition had been withdrawn. Though the counsel for the respondent No.1 submitted that the instant petition has been rendered infructuous, however, counsel for the petitioner sought an accommodation to assist.

On the last date of hearing, the petitioner was unrepresented. Even today, the position remains the same.

It appears that the petitioner is not interested in pursuing the present petition.

In view of such circumstances, present petition is dismissed for want of prosecution.

All the pending miscellaneous applications, if any, stand disposed of.
