The jurisdiction of this Court has been invoked under Article 226/227 of the Constitution of India for issuance of a writ in the nature of certiorari for quashing the order dated 16.03.2026 (Annexure P-1) revoking the stay of demand, passed by respondent No.1.

At the outset, learned counsel for the petitioner submits that the appeal of the petitioner is pending since 12.11.2021 with the respondent No.2. He further submits that he will be satisfied in case a direction be issued to respondent No.2 to decide the appeal of the petitioner.

Accordingly, without commenting upon the merits of the case, the respondent No.2/Principal Chief Commissioner of Income Tax (NFAC) is directed to get the appeal decided preferably within a period of four weeks from the date of receipt of certified copy of this order, after providing opportunity of hearing to the MEENU 2026.06.04 10:30 I attest to the accuracy and integrity of this document
