Present petition under Section 439 (2) Cr.P.C. for setting aside the impugned order dated 09.04.2019 (Annexure P5), passed by the learned Judicial Magistrate, Kanina in a criminal complaint case bearing No. 10 dated 24.09.2015, under Sections 420, 467, 468, 471, 120-B, 166 & 217 IPC.

Learned counsel for the petitioner submitted that he may be permitted to withdraw the present petition with liberty to the petitioner to approach the same Court which had granted regular bail to respondent No.1, namely Ashok Kumar.

In view of above, present petition stands dismissed as withdrawn with the liberty aforesaid.
