The matter is taken up for hearing through video conference due to COVID-19 situation.

The present petition is filed seeking regular bail in FIR No. 107 dated 18.7.2020, under Section 22 of the NDPS Act, 1985, registered at Police Station Khuian Sarwar, District Fazilka. Learned counsel for the petitioner restricts his prayer only for grant of interim bail on account of marriage of daughter of the petitioner which is fixed for 6.11.2020. It is argued that there is no adult male member in the family.

Learned counsel for the State opposes the prayer for grant of interim bail submitting that recovery from the petitioner was very heavy i.e. one lakh intoxicating tablets and there is chance that he will misuse the PANKAJ BAWEJA 2020.10.28 01:37 I attest to the accuracy and integrity of this document High Court, Sector-1, Chandigarh

Considering that marriage of petitioner's daughter is fixed and there is no male member in the family, the petitioner is permitted to attend the marriage on 6.11.2020.

Superintendent, Central Jail, Faridkot is directed to make necessary arrangement to take the petitioner in police custody for attending the marriage ceremony of his daughter between 10.00 AM to 4.00 PM on 6.11.2020 at his expenses and thereafter shall bring him back to the jail in safe custody. The Jail Superintendent is also directed to take all precautionary measures of COVID-19 before taking the petitioner for attending the marriage ceremony and reverting back to judicial lock up. The petition stands disposed of.
