The petitioner seeks issuance of a writ in the nature of mandamus so as to direct the respondents to restore the supply of essential goods to the ration depot of the petitioner.

Learned counsel for the petitioner submitted that the petitioner had been running a ration depot at District Kaithal, Haryana since the last more than 17 years but somehow all of a sudden the supply of essential goods to her ration depot was suspended vide order dated 17.5.2023 (Annexure P-1) passed by District Food, Civil Supplies & Consumer Affairs Controller, Kaithal on the allegation that some additional stock of wheat was found lying in her ration depot, which could not be accounted for. It has been submitted that the

( 2 ) petitioner challenged the aforesaid order dated 17.5.2023 (Annexure P-1) by way of filing an appeal before respondent No.2 - Deputy Commissioner-cumCollector, Kaithal, District Kaithal and respondent No.2 vide order dated 13.6.2023 (Annexure P-3) set aside the order dated 17.5.2023 (Annexure P-1) passed by District Food, Civil Supplies & Consumer Affairs Controller, Kaithal and remanded the matter back for a fresh decision after affording proper opportunity of hearing to the petitioner. It has been contended that ever since the remand of matter no steps have been taken by District Food, Civil Supplies & Consumer Affairs Controller, Kaithal and nor the supply of essential goods to the ration depot of the petitioner has been restored. 3.

Notice of motion.

Pursuant to an advance copy of petition having been furnished to the State, Mr. Sharad Aggarwal, DAG, Haryana puts in appearance and accepts notice. 5.

Having regard to the nature of case, the same is disposed of with a direction to respondent No.3 - District Food and Supplies Controller, Kaithal, District Kaithal to take a decision in the matter of suspension of supply of essential goods to the ration depot of the petitioner, which is stated to be pending, pursuant to order dated 13.6.2023 (Annexure P-3) passed by respondent No.3 - Deputy Commissioner-cum-Collector, Kaithal, District Kaithal, expeditiously preferably within a period of 3 weeks from today. In case, no decision is taken during the said 3 weeks, the supply of essential goods shall be restored to the ration depot of the petitioner. 6.

A copy of this order be furnished to respondent No.3 - District Food and Supplies Controller, Kaithal, District Kaithal for necessary compliance.
