Petitioner seeks grant of anticipatory bail under Section 438 Cr.P.C. in case bearing FIR No.796 dated 23.12.2017 registered under Section 10 of Haryana Urban Development Act and under Sections 406, 420 IPC at Police Station Badshahpur, District Gurugram.

CRM-M No. 30294 of 2019 -2Vide order dated 18.07.2019, this petition was ordered to be listed along with CRM-M No.28952 of 2019 and interim order was passed in the same terms as passed in CRM-M No.28952 of 2019 on 16.07.2019.

Learned counsel for the petitioner submits that during the investigation of the case, petitioner was on interim protection and the police after investigation of the case has submitted the challan on 16.07.2020 under Section 10 of Haryana Urban Development Act and offence under Sections 406, 420 IPC have been dropped.

Learned State counsel admits the factum of filing of challan under Section 10 of Haryana Urban Development Act and deletion of offences under IPC.

Since challan has already been submitted, further investigation vis-a-vis involvement of the petitioner is not required.

In view of above, petitioner is directed to appear before the trial Court within fortnight. On his appearance, the trial Court shall grant him regular bail to its satisfaction. Disposed of.
