IN THE HIGH COURT OF PUNJAB AND HARYANA
AT CHANDIGARH CRM-M-29306-2026 Date of decision: 27.05.2026 BALWINDER SINGH @ BOHAR ......Petitioner
VERSUS
STATE OF PUNJAB .......Respondent CORAM : HON'BLE MR. JUSTICE VINOD S. BHARDWAJ ***** Present: - Mr. Jaswinder Singh Rana, Advocate for the petitioner.
Mr. Mohit Kapoor, Senior DAG, Punjab.
***** VINOD S. BHARDWAJ, J. (Oral) 1.
The instant second petition has been filed under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023, for the grant of regular bail in case bearing FIR No. 247 dated 22.11.2025, registered under Section(s) 25 of the Arms Act, 1959 (offences under Sections 25(6), 25(7), 25(8), of the Arms Act, 1959 added later on) at Police Station Cantonment, District Amritsar.
2.
Learned Counsel appearing on behalf of the petitioner contends that the case of the petitioner would be similar to co-accused Yugraj Singh @ Jhagga @ Jograj Singh to whom concession of regular bail has been granted vide order dated 14.05.2026 passed in CRM-M-10964-2026 except VISHAL SHARMA 2026.05.28 10:53 I attest to the accuracy and integrity of this document
CRM-M-29306-2026 -2for a difference that while two pistols have been recovered from the said coaccused, five pistols had been recovered from the petitioner herein. He contends that as against the same, the petitioner has undergone longer period of custody. He further contends that the petitioner has no criminal antecedents in the present case and his case would be at par with the said coaccused. 3.
Counsel for the respondent-State is not in a position to assign any other difference between the case of the petitioner as compared to coaccused Yugraj Singh @ Jhagga @ Jograj Singh other than number of weapons recovered.
4.
Without commenting on the merits of the present case and taking into consideration that similarly placed co-accused has already been granted concession of regular bail, I deem it appropriate to enlarge the petitioner on regular bail to the satisfaction of the trial Court. 5.
The instant petition is allowed and the petitioner is ordered to be released on regular bail on his furnishing requisite bail bond/surety bond to the satisfaction of the trial Court/Duty Magistrate, concerned. 6.
It is made clear that the petitioner shall not extend any threat and shall not influence any prosecution witnesses in any manner directly or indirectly.
7.
The observation made hereinabove shall not be construed as an expression on the merits of the case and the Trial Court shall decide the case on the basis of available material.
