The petitioner may write to the bank for defreezing the account by appending the ultimate result of the criminal complaint for alleged offence under Section 420 IPC since, according to the petitioner, it was the registration of the complaint that gave rise to the police making such a communication to the bank. I would hold that the bank itself has no power to direct the accounts to be frozen without taking an order from the Court. The bank may engage in an appropriate communication with the police from whom they had received that instruction to point out to any subsisting case against the petitioner which exists and take a decision to defreeze the account. The entire exercise shall be done within a period of four weeks from the date of receipt of copy of this order.
