******* SURINDER GUPTA, J.(Oral) Both the aforementioned petitions have been filed under Section 439 Code of Criminal Procedure for grant of regular bail to the petitioners in case FIR No.56 dated 14.05.2019 registered for the offence punishable under Sections 419, 420 read with Section 120-B of Indian Penal Code, at Police Station Dasuya, District Hoshiarpur. Heard.

CRM-M-30720-2019(2 petitions) -2Avaneesh had applied for the post in Civil Supplies Department of Army. During the physical test of Avaneesh, he had sent Seetu, resident of Ferozabad and for written test, he had appeared himself. Petitioner Parveen Kumar had sent one Sanjay of Haryana for his physical test. In this manner, both have tried to secure the government job by cheating the State and sending impersonators on their behalf for physical test. Both the petitioners were arrested on 14.05.2019. After completion of investigation, challan has been presented and trial is in progress.

Keeping in view the above facts and that conclusion of trial will take considerably long time but without expressing any opinion on merits of the case, both the petitions are allowed. Petitioners Parveen Kumar and Avaneesh are ordered to be released on regular bail on furnishing bail bonds and surety bonds to the satisfaction of concerned Chief Judicial Magistrate/Duty Magistrate, subject to following terms:- a. The petitioners shall comply with the conditions mentioned in Section 437(3) Cr.P.C.

b. In the event of their absence on any date of hearing, the benefit of bail allowed to the petitioners shall stand withdrawn. The trial Court shall be competent to cancel their bail bonds and surety bonds and proceed to procure their presence in accordance with law. In that eventuality, the petitioners shall have to apply for bail afresh.

c. They shall not leave the country without prior permission of the Court.
