Ranjit Kaur And ANR. v. State Of Punjab And ORS.
IN THE HIGH COURT OF PUNJAB AND HARYANA AT
CHANDIGARH CWP-17861-2017 (O&M) Date of decision: May 12, 2022 Ranjit Kaur and another ....Petitioners versus State of Punjab and others ....Respondents CORAM: HON'BLE MR. JUSTICE ARUN MONGA
Present:
Mr. K.G. Chaudhary, Advocate for the petitioners. Ms. Ambika Bedi, AAG, Punjab.
Mr. Sandeep Godara, Advocate for Mr. Mohit Jaggi, Advocate for respondent No.3. ***** ARUN MONGA, J. (ORAL) Petition herein, inter alia, is for issuance of a writ in the nature of Certiorari to quash impugned order dated 11.07.2017 (Annexure P-4), whereby respondent No.2 has ordered eviction of the petitioners, allegedly in summary exercise of powers.
2.
It transpires that during pendency of the writ petition, senior citizen-respondent No.3, at whose instance, the Maintenance Tribunal had passed the impugned order, has since expired, and therefore, the proceedings before this Court are abated and are rendered infructuous. 3.
Petition is accordingly disposed of. However, it is made clear that eviction order impugned herein was/is co-terminus during lifetime of the senior citizen and the same is accordingly, set aside being un-implementable after the unfortunate death of senior citizen during pendency of the proceedings. Accordingly, parties are left to seek their alternative civil remedy, as may be available under law.
