Through instant petition, preferred under Article 226 of the Constitution of India, petitioner has sought issuance of a writ in the nature of mandamus directing the respondents to count daily wager service w.e.f. 01.04.1978 to 01.04.1987 & 01.04.1987 to 01.03.1991 on work charge basis. Service of the petitioner has been brought on regular establishment on 01.03.1991 as ALM petitioner is entitled to count the entire service as qualifying service for the purpose of pensionary benefits with all consequential benefits along with interest @ 18% per annum from the date of accrual till the date of realization.

Learned counsel for the petitioner submits that though legal notice dated 29.01.2018 (P-5) was duly served upon the respondents but till date neither any reply to the said legal notice has been received nor any conscious decision has been taken by the respondents. CWP No.16139 OF 2018 --2-- feels satisfied in case direction is issued to respondent No.2 to decide legal notice (P-5) in a time bound manner.

Accordingly, instant petition is disposed of with a direction to respondent No.2-Chief Engineer/Operation Circle, UHBVNL, Panchkula to look into the grievances unfolded by the petitioner in legal notice (P-5) and to decide the same within a period of three months from the date of receipt of a certified copy of this order.

However, if petitioner still feels aggrieved by any of the orders passed by the aforesaid authority concerned, he shall be at liberty to have recourse to the remedies available under law as well as to approach this Court.
