**** HARSIMRAN SINGH SETHI , J. (ORAL) In the present writ petition, the grievance which is being raised by the petitioner is that his service, which he had rendered from 19.08.1974 till 14.08.1980 in the Department of Rural Development and Panchayat, prior to his joining of the Education Department in the year 1980, has not been counted as a qualifying service for the grant of pensionary benefits.
Counsel for the petitioner argues that under Rule 3.17(A) of the Punjab Civil Services Rules, the service which has been rendered by an employee under the State, is liable to be counted as a qualifying service for the grant of pensionary benefits. CWP-19512-2019 -2respondents with a legal notice dated 12.03.2019 (Annexure P-4), which is still pending consideration with the respondents and the petitioner will be satisfied, at this stage, in case a time bound direction is issued to the respondents to decide the said legal notice.
In view of the request made, without expressing any opinion on the merits of the case or the claim being made by the petitioner, the respondents are directed to decide the legal notice dated 12.03.2019 (Annexure P-4) by passing a speaking order within a period of three months from the date of receipt of a certified copy of this order. Present writ petition stands disposed of.
