Petitioners have filed this petition under Article 226 of the Constitution of India seeking a writ in the nature of certiorari for quashing Annexure P-3, minutes dated 12.09.2014.
I have heard learned counsel for the parties and have gone through the record available on the file carefully. Learned State counsel on instructions from Dr.
KAPIL 2016.02.05 16:38 I attest to the accuracy and authenticity of this document CWP No.23124 of 2014 [2] *** Anjuman Bhaskar, Deputy Director, Food and Civil Supplies, has submitted that food grain in question belongs to Food Corporation of India.
Since, the food grain in question belongs to the Food Corporation of India, it is for the said Corporation to get the food grain shifted/loaded at the rail heads from the labour as per its choice. Petitioners or respondent No.8 i.e. Galla Mazdoor Union cannot insist that the food grain is liable to be lifted by either of them. It is for the Food Corporation of India to decide as to from whom they want to lift their foodgrain at the rail heads. Accordingly, this petition is disposed of with a direction that the Food Corporation of India shall be at liberty to get its food grain lifted at the rail heads from the labour of its choice. Respondents No.4 and 5 are directed to provide adequate security for lifting of the food grain by the Food Corporation of India at the rail heads.
