After arguing for considerable time, learned counsel for the petitioner wants to withdraw the present petition with liberty to file fresh petition. Given above, the present petition stands disposed of having been withdrawn.
It is clarified that withdrawal of the present petition shall not come in the way, in case, fresh petition is filed. It shall be open for the petitioner to file a fresh petition under Section 439 Cr.P.C. directly before this Court.
