The petitioner is seeking quashing of order dated 03.02.2025 (Annexure P-4) passed by learned Additional Sessions Judge, Sri Muktsar Sahib in SC No.209 of 2022 titled as State of Punjab Vs. Varinderpal Singh in FIR No.151 dated 13.09.2021 under Sections 399, 402 IPC, 1860 registered at Police Station Gidderbaha, District Sri Muktsar Sahib whereby bail of the petitioner was cancelled and his bail bonds have been forfeited to the State and non bailable warrants have been issued qua him. 2.

Learned counsel for the petitioner contends that on 03.02.2025, the petitioner was behind bars in another FIR bearing No.191 dated 23.12.2024 under Sections 15(b), 27 of NDPS Act, 1985 registered at Police Station City Malout and the said fact was also informed to his counsel but he failed to inform the trial Court and has not moved any exemption application, therefore, his bail was cancelled and his bail bonds were forfeited to the State. He further states that vide order dated 31.01.2025 (Annexure P-3), the petitioner was released on Sonia Puri 2025.05.29 14:35 I attest to the accuracy and integrity of this document

CRM-M-30101-2025 -2bail in FIR No. 191 dated 23.12.2024 under Sections 15(b), 27 of NDPS Act, 1985 registered at Police Station City Malout. However, he submits that he is willing and ready to join the proceedings and shall appear before the trial Court as and when required. Learned counsel for the petitioner, on instructions further submits that the petitioner undertakes to appear before the trial Court on each and every date and shall not seek any exemption for his personal appearance on any date of hearing before the trial Court. Hence, in the aforementioned facts and circumstances, the petitioner prays that directions be issued to the Trial Court that his bail application, which he would be filing on his surrender, be decided. 3.

Keeping in view the facts of the case, the service of respondent is dispensed with as it will delay the proceedings.  4.

I have heard learned counsel for the petitioner and perused the material placed on record.

No ground to interfere in the impugned order dated 03.02.2025 is made out and the present petition is hereby, dismissed. 6.

However, the petitioner is directed to appear and surrender before the trial Court concerned within a period of 07 days from today and may file bail application before the concerned Court. In case, he does so, the same be considered by the trial Court concerned, in accordance with law, within a period of 03 days.
