The present second petition under Section 439 Cr.P.C. for grant of regular bail to the petitioner has been filed in FIR No.64 dated 22.06.2015, under Sections 376-D/302/201/419/120-B IPC and Section 6 of POCSO Act, registered at Police Station Ghuman, District Batala. 2.

Learned counsel for the State submits that the petitioner is the main accused and he was declared proclaimed offender on 17.01.2023 and was arrested on 29.03.2023 and now the trial is going on and is at the stage of prosecution evidence.

In view of the submission made by learned counsel for the State that since the petitioner was declared proclaimed offender and the trial is just commenced and moreover, the conduct of the petitioner and the gravity of the offence does not make him entitled to grant of concession of regular bail.
