HARINDER SINGH SIDHU,J Prayer is for grant of regular bail in case FIR No.9 dated 15.01.2019 under Sections 341,323,506,148,149 IPC ( Section 308 and 325 added later on) registered at P.S Bhawanigarh, District Sangrur. Allegations in the FIR, which was registered on the statement of one Gurdeep Singh are that on 13.1.2019 at about 8.30 p.m, he along with his cousin Gagandeep Singh was going towards Goushala Chowk. The petitioner and his brother Shankey accompanied by 2/3 other persons suddenly restrained them. The petitioner is alleged to have given a gandasa blow from the reverse side on the head of the complainant while Shankey gave dang blow to him. While the complainant was lying down, petitioner and Shankey gave more blows on his arms. On the noise being raised, people collected and the assailants ran away.

Learned state counsel on instructions from ASI Pritpal Singh, has opposed the petition stating that after completion of investigation, challan has been filed and only examiniation-in-chief of the complainant MANOJ KUMAR 2019.10.

CRM-M-30699 of 2019 #2# has been conducted.

The petitioner has been in custody for the last more than eight months.

The trial of the case may take long time. No useful purpose will be served by keeping the petitioner in custody till the final disposal of the case.

Keeping in view the facts and circumstances of the present case; without discussing the facts in minute detail and without expressing any opinion on the merits of the case, this criminal miscellaneous petition is allowed and the petitioner is ordered to be released on bail subject to his furnishing bail bonds and surety bonds to the satisfaction of the trial Court/Duty Magistrate, Sangrur.
