The petitioners approached this court with a grievance that allotment of plots has been made to certain persons in violation of the policy of the Government dated 17.4.2001 regarding allotment of plots to Scheduled Castes and other downtrodden families without house, to build their own houses.

Learned counsel appearing for respondent No. 5 stated that the Gram Panchayat having found that there were some irregularities in the process of allotment of plots, a resolution has been passed. The same has been sent to Block Development and Panchayat Officer for further action. The petitioners had also made representations to Sub Divisional Magistrate and Deputy Commissioner regarding illegal allotments.

CWP No. 21516 of 2016 [2] As on a re-consideration of the matter, even the Gram Panchayat found that there were some irregularities in the process of allotment and the resolution passed by it has been sent to Block Development and Panchayat Officer for consideration and appropriate action, in our opinion, the present petition can be disposed of at this stage with a direction to Block Development and Panchayat Officer to take a final decision in the matter within a period of three months from the date of receipt of copy of the order. Ordered accordingly. As stated by learned counsel for the petitioners, the allottees had started raising construction after the allotments were made in September, 2016. Any such action may prejudice the case of either of the parties, hence, it is directed that till such time the matter is finally decided by the Block Development and Panchayat Officer, status quo shall be maintained.
