Learned counsel submits that the petitioner, a handicap retired from service on 30.11.2021 as Clerk and was granted only provisional pension on account of the FIR having been registered against him, trial wherein was pending. He now stands acquitted vide judgment dated 29.11.2022, Annexure P-4, however, still the retiral benefits have not been released as also the salary for the period, he remained under suspension and his claim for promotion as Senior Assistant also requires to be considered and no departmental proceedings were initiated against him and an inter departmental communication dated 22.07.2024, Annexure P-2, with regard to the release of the benefits, whereupon also the dues had not been released, prompting the petitioner to serve a legal notice dated 07.05.2025, Annexure P-3, however, the same has yet not evoked any response. He thus, on instructions prays that a direction may be given to the respondents to decide the same in a time bound manner, to which learned State counsel has no objection to the limited prayer made.

In view of the above and without commenting on the merits of the case, this petition is hereby disposed of with a direction to the respondents to decide the legal notice dated 07.05.2025, within a period of 4 months, which this Court has no reason to believe the authorities would not address in a just, fair and reasonable manner. Upon doing so, after notice and hearing offered to him and if found entitled, grant the benefit forthwith. Needless to say, if the orders are adverse to his interest, the same shall contain reasons and the petitioner shall be free to seek legal redress thereupon.
