The petitioners seek cancellation of a transaction for the purchase of a property secured in favour of respondent No.3 - Diwan Housing Finance Corporation Limited.

The property belongs to a private party and was secured in favour of respondent No.3. The sale was conducted by respondent No.3 under the provisions of the Securitization and Reconstruction of Financial Assets and Enforcement of Securities Act, 2002. Neither respondent No.3 nor the owner of the property is State within the meaning of Article 12 of the Constitution of India. They are purely private parties.
