PANKAJ JAIN, J. (ORAL) Prayer is for interim bail on the ground that the wife of the petitioner has to undergo surgery. 2.
Petitioner is facing incarceration for being accused in FIR No.248 dated 08.10.2019 registered for offences punishable under Sections 21, 23, 61, 85 of the NDPS Act, 1985, at Police Station Sadar, Fazilka. 3.
Today, report by way of affidavit of Shubeg Singh, PPS, DSP, Sub Division Fazilka, District Fazilka has been filed on behalf of respondent No.1 today in Court, which is taken on record. 4.
As per the same, the medical state of the wife of the petitioner has been verified and it has been reported as under: 5.
That it is submitted that the Doctors of Civil Hospital, Ferozepur has given 11.03.2024 as the date for performing surgery
of the patient Neelam wife of the petitioner, as per the OPD slip dated 19.02.2024 issued by the said Hospital. Copy of the said OPD slip is annexed herewith as Annexure R-1. 5.
In view of above the petitioner is ordered to be released on interim bail subject to the satisfaction of the Jail Authorities concerned, on 7th of March, 2024. The petitioner is directed to surrender back on 19th of March, 2024 at 11.00 AM before the concerned Jail Authorities. 6.
However, in addition to conditions that may be imposed by the Jail Authorities concerned, the petitioner shall remain bound by the following conditions :- (i) The petitioner shall not mis-use the liberty granted. (ii) The petitioner shall not tamper with any evidence oral or documentary during the trial. (iii) The petitioner shall not absent himself on any date before the trial. (iv) The petitioner shall not commit any offence while on bail. (v) The petitioner shall deposit his passport, if any with the Trial Court/Jail Authorities. (vi) The petitioner shall give his cellphone number to the police authorities and shall not change his cellphone number without permission of the trial Court. (vii) The petitioner shall not in any manner try to delay the trial.

In case of breach of any of the aforesaid conditions and those which may be imposed by the Jail Authorities, the prosecution shall be at liberty to move cancellation of bail of the petitioner. 8.
Petition stands disposed off accordingly.
