This matter is being taken up for hearing through video conferencing due to the outbreak of pandemic, COVID-19. This is petitioner's second petition for grant of bail pending trial in FIR No.230 dated 25.10.2019, registered under Section 420 of IPC and Section 24 of the Immigration Act, Police Station I.T. Park, Chandigarh. The matter was placed before the Mediation and Conciliation Centre of this Court on the specific averments of the petitioner that he seeks to settle the dispute with the complainant and that as there is none to pursue the matter, interim bail was afforded to enable the petitioner to settle the matter. CRM-M-34898-2020 (O&M) as is recorded in order dated 22.02.2021 with interim bail being extended. However, petitioner did not honour the terms and conditions of the agreement dated 19.01.2021 and petitioner was directed to surrender before the jail authorities by 3:00 P.M. on 06.10.2021. Petitioner did not surrender and it was directed by this Court on 08.11.2021 that necessary steps be taken by the respondent-State to take the petitioner in custody before the next date of hearing.

Mr. Jain, representing Union Territory, Chandigarh, submits that petitioner has not yet been taken in custody. It is apparent that the petitioner has misused the concession of interim bail afforded to him by this Court and today there is no representation on his behalf.

This petition is, accordingly, dismissed for non-prosecution. As the petition for grant of bail pending trial has been dismissed, CRM No.35299 of 2021 for grant of interim arrest stay to the petitioner is also dismissed as rendered infructuous. Let necessary steps be taken by the respondent-State to take the petitioner in custody. A report by way of affidavit of the competent officer in this respect, be filed by 24.02.2022.
