Prayer in the present petition, filed under Section 482 of the Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023, is for grant of anticipatory bail to the petitioner in FIR No.76 dated 08.04.2025, under Section 304 of the Bharatiya Nyaya Sanhita (BNS), 2023, registered at Police Station City Gurdaspur, District Gurdaspur. Briefly, the aforesaid FIR was registered on the basis of statement made by one Gurbinder Kaur wife of Hardeep Singh, wherein it was stated that on 07.04.2025 at about 04:00 PM, near Happy School, Jail Road Gurdaspur, two young persons snatched her purse containing a mobile phone, two pairs of gold ear-rings, one gold finger-ring and cash amount of Rs.20,000/- besides other valuable documents, stamp of School and letter head.
Learned counsel for the petitioner contended that the petitioner
was not named in the FIR and he has been falsely implicated on the basis of suspicion. There is no material available on record to connect the petitioner with the alleged incident in the present case. Learned counsel further submitted that the petitioner is ready and willing to join investigation and therefore, he be granted concession of anticipatory bail. Learned State counsel, on the other hand, has vehemently opposed the present bail petition and has contended that the snatched mobile phone was found in possession of the petitioner and on this basis, he was nominated as accused in the present case. He has also contended that the other valuables, which were snatched, are also to be recovered. So, custodial interrogation of the petitioner is required and he does not deserve concession of anticipatory bail.
Heard.
During investigation, the sims used in the snatched mobile phone were traced on basis of specific IMEI number. Those sims were of mobile repair shops and it was disclosed that said mobile phone was brought by the petitioner Arashdeep Singh and on this basis, the petitioner was nominated as accused in the present case.
As per the Status Report, four other criminal cases had also been registered against the petitioner, as per police record of Police Station City, Gurdaspur. The snatched purse was containing one mobile phone, one pair of gold ear-rings, one gold finger ring, cash amount of Rs.20,000/-, some valuable documents, stamp of school and letter-head. All the aforesaid articles are yet to be recovered. As such, custodial interrogation of the petitioner is required and if the same is denied to the investigating agency, it
may create hurdles in the investigation and would prejudice the investigation.
Accordingly, without commenting on the merits of the case, this Court is of the opinion that there is no merit in the present petition and no ground is made out for granting anticipatory bail to the petitioner. Dismissed.
