The petitioner has approached this Court seeking grant of anticipatory bail in respect of a case registered vide FIR No.320, dated 12.6.2022, Police Station Baldev Nagar, District Ambala, under Section 174-A of Indian Penal Code. 2.
Learned counsel for the petitioner submits that the matter infact has arisen out of a complaint under Section 138 of Negotiable Instruments Act, which already stands amicably resolved and vide order dated 2.7.2022 (Annexure P-8) passed by learned Judicial Magistrate 1st Class, Ambala, the said complaint was dismissed as withdrawn pursuant to a compromise amongst the parties.

In view of the aforestated position, the instant petition is disposed off with a direction that in case the petitioner surrenders before the Trial Court in respect of FIR No.320, dated 12.6.2022 within a period of one week from PANKAJ KAKKAR 2022.08.16 14:16 I attest to the accuracy and authenticity of this document
( 2 ) CRM-M-35758-2022 (O&M) today and applies for grant of regular bail, the learned trial Court shall endeavour to dispose of the same expeditiously preferably on the day of filing of such application while duly keeping in view the fact that the main case, out of which the present proceedings have arisen i.e. complaint under Section 138 of Negotiable Instruments Act already stands disposed of having been compromised.

At this stage, Mr. Rajesh Kumar Kashyap, Advocate representing the complainant in complaint under Section 138 of Negotiable Instruments Act, has put in appearance and has filed Power of Attorney, which is taken on record.

Learned counsel for the complainant has submitted that he has no objection in case the petitioner is granted bail.

As already stated above, the Court shall duly take into account the factum of compromise amongst the parties.
