***** JASPAL SINGH, J.(Oral) Though by virtue of instant petition preferred under Article 226/227 of the Constitution of India, petitioner has sought issuance of a writ in the nature of certiorari seeking quashing of order dated 27.04.2016 (P-4) passed by respondent No.2 with further direction to release the pensionary benefits i.e. GPF, gratuity, leave encashment and full monthly pension along with interest as well as to release salary from 29.01.2016 till the date of his superannuation, yet, learned counsel restrict his claim for the time being for the issuance of direction to respondent-appellate authority i.e. Secretary, Government of Punjab, Education Department (School), Punjab Mini Secretariat, Chandigarh to dispose of the statutory appeal preferred by petitioner dated 13.07.2017 (P-6) within some stipulated period in the light of documents already available on file or filed subsequent by petitioner including Civil Court decree dated 27.11.2017 (PSonika 2018.07.10 15:51 I attest to the accuracy and authenticity of this document Chandigarh

Without expressing any opinion on the merits and without prejudice to the rights of petitioner, instant petition is disposed of with the direction to Secretary, Government of Punjab, Education Department (School), Punjab Mini Secretariat, Chandigarh, (appellate authority) to take a final decision on the appeal preferred by petitioner against order dated 21.06.2017 passed by Director Education Department (Secondary Education), (Punjab) within a period of four months positively from the date of receipt of certified copy of this order. 3.
In case of non-compliance of aforesaid direction as well as in the event of passing of any adverse order, petitioner shall be at liberty to approach this Court as well as to have recourse to the other remedies available under law.
