Prayer in this writ petition is for directing the respondents to grant petitioner the pay-scale of Lower Division Clerk (LDC) as admissible from 13.01.1995 upto June 2006 with all consequential benefits as admissible to the said post since January, 1995.
It is submitted that petitioner was appointed with the respondentDepartment as a T-mate on 08.09.1993 on regular basis in the pay-scale of `7701050/-. He was promoted to the post of Assistant Lineman (ALM) in the year 2006 but was not assigned the particular job of ALM till May, 2014. CWP No.22532 of 2015 [2] was however marking his presence in the office on the post of LDC. He, therefore, prays for grant of pay-scale of the said post. It is contended that despite serving legal notice dated 01.05.2015 (Annexure P5) upon the respondents, no action is being taken by the respondents on the claim raised by the petitioner. It is prayed that legal notice, Annexure P5, served upon the respondents be directed to be decided by the authorities in a time bound manner. Keeping in view the limited prayer addressed at the time of arguments, the facts and circumstances of the case but without expressing any opinion on the merits of the controversy, present writ petition is disposed of with a direction to the competent authority to expeditiously decide legal notice dated 01.05.2015 (Annexure P5) served upon them by the petitioner by passing a speaking order, preferably within a period of four months from the date of receipt of a certified copy of this order.
