Apprehending threat to his life and liberty at the hands of the private respondents, the petitioner, invoking the fundamental right of life guaranteed under Article 21 of the Constitution of India, has come up before this Court seeking protection through the State.

State's counsel appears pursuant to advance notice. Mr. A.D.S. Jattana, Advocate appears for respondent no.5 and filed his power of attorney, which is taken on record. 3.

Counsel for respondent no.5, on instruction, submits that there is nothing to fear from him and the allegations levelled against him are false and baseless and there is concealment of material facts by the petitioner. He further submits that presently, the petitioner is abroad and by seeking protection, he is wasting the precious time of the Court and thus, the present petition deserves to be dismissed with heavy costs. 4.

On this, counsel for the petitioner submits that at the time of filing the present petition, the petitioner was very much in India and as of now, he may have travelled abroad, but the moment he arrives in India, the apprehension of threat to his life is very much there.

Given above, once the petitioner is not in India, this Court cannot pass any order for his protection.

Accordingly, the present petition is dismissed, with liberty to the petitioner that in case he returns to India and apprehends any threat to his life and liberty, he may make a representation to the concerned SHO/S.P., who shall act thereon in accordance with law.
