**** HARSIMRAN SINGH SETHI , J. (ORAL) The claim which is being raised by the petitioner is that her late husband, namely, Sh. Sita Ram, was working with the respondents as a Clerk and unfortunately he died on 13.02.2018, while in service. Counsel for the petitioner states that at the time of death, late husband of the petitioner had 22 years of service to his credit and all the benefits, for which the petitioner is entitled for in respect of the service rendered by her late husband, has not been extended to her and only a sum of `25,000/- as ex-gratia has been given to her. Counsel further states that no other benefits under the Haryana Compassionate Assistance to the Dependents of Deceased Government Employees Rules, 2006 have been extended to the petitioner by the respondents and the claim of the NARESH KUMAR 2019.07.30 12:05 I attest to the accuracy and integrity of this document Chandigarh

CWP-20127-2019 -2petitioner in this writ petition is for the release of the benefits for which she is entitled for after the death of her husband in respect of the service rendered by him.

Counsel for the petitioner states that for the relief which has been sought in the present writ petition, petitioner has served the respondents with a legal notice dated 08.05.2019 (Annexure P-7), which is still pending consideration with the respondents and the petitioner will be satisfied, at this stage, in case a time bound direction is issued to the respondents to decide the said legal notice.

In view of the request made, without expressing any opinion on the merits of the case or the claim being made by the petitioner, the respondents are directed to decide the legal notice dated 08.05.2019 (Annexure P-7) by passing a speaking order within a period of three months from the date of receipt of a certified copy of this order. In case after the decision, it is found that the petitioner is entitled for any monetary benefit, the same shall also be released to her within a period of next three months.

Present writ petition stands disposed of.
