Through the instant petition, prayer is made for issuance of a direction upon respondents no.1 to 7 to protect the life and liberty of the petitioner at the hands of respondents no.7 to 23, who are allegedly extending threats to him.

In deference to the directions issued by this Court vide order dated 10.07.2024, a short reply, dated 30.07.2024, by way of an affidavit of Sh.Gurinderbir Singh, ACP (East), Amritsar City, has been filed, by the learned State counsel today in Court, which is taken on record, with a copy thereof, supplied to learned counsel for the petitioner. 3.

The relevant extract of the reply (supra) reads as under:2 3.

That the respondent No. 6 has reported in his aforesaid report dated 26.07.2024 that an enquiry relating to the subject matter of the present petition has been conducted through ASI Amarjit Singh, who has recorded the statement of the petitioner DHARAM VIR 2024.08.02 17:40 I attest to the accuracy and integrity of this document



 

 and private respondents and during the course of enquiry, the petitioner could not produce any witness or evidence relating to any threat. It has been further reported that during the enquiry, the private respondents had stated in their respective statements that the petitioner is filing false applications against them in order to blackmail them to extract money from them. The true translation of the aforesaid report dated 26.07.2024 submitted by the respondent No. 6 is attached herewith for the kind perusal of this Hon'ble Court as Annexure R21/T.

That it is pertinent to mention here that the petitioner is a habitual offender. As per the record available at Police Station B2division Amritsar City, the petitioner is found involved/nominated as accused in five criminal cases which are reproduced as under:

(i) FIR No. 203 dated 11.12.2016 under section 452, 323, 506/34 IPC Police Station B2division Amritsar, (ii) FIR No. 58 dated 16.05.2018 under section 323, 354, 506, 148 IPC, Police Station B2division Amritsar, (iii) FIR No. 265 dated 24.08.2022 under section 307, 148 and 1491PC read with section 25 and 27 Arms Act, Police Station B2division Amritsar, (Declared innocent): (iv) DDR No. 24 dated 14.08.2018 under section 107/151 Cr.PC, Police Station B2division Amritsar;

(v) FIR No. 115 dated 24.07.2024 under section 126 (2), 109 3 (5), 351 (2) Β.Ν.S read with section 25 Arms Act, Police Station B2division Amritsar 5.

That it is humbly submitted that the petitioner is absconding to avoid his arrest in case FIR No. 115 dated 24.07.2024 under section 126 (2), 109 3 (5), 351 (2) B.N.S read with section 25 Arms Act registered at Police Station B2division Amritsar City and there is no threat perception to the life and liberty to the petitioner."

From the perusal of the above, it reflects that there is no threat perceptions to the present petitioner, at this stage, therefore, this Court refrains to pass any directions, as sought by the present petitioner. Therefore, the instant petition is ordered to be closed. 5.
