In the present case, the appellant has sought declaration for correction of his date of birth in the Matriculation Certificate. 2.

It is the claim of the appellant that his correct date of birth is 18.10.1989, however, the same has wrongly been mentioned as 18.10.1990 in the Matriculation Certificate. Accordingly, he had sought correction of the same.

Both Courts have non-suited the appellant on the ground of limitation, as the appellant did not challenge the correction of date of birth within three years of attaining majority.

In view of the law laid down by the Division Bench of this Court in LPA No.1613 of 2014 titled as Ambika Kaul Vs. Central Board of Secondary Education and others decided on 21.05.201 5 , both the Courts have correctly held the claim to be barred by limitation as petitioner had filed suit in the present case only after attaining the age of 30 years. Appellant is doing a private job and has failed to give reasons for not approaching the Court for correction of his date of birth within the statutory period of three years from the date of attaining majority. Petitioner was throughout aware of date of birth as noted in birth certificate and Matriculation Certificate. Failure to get it corrected in time fixed makes appellant's claim, stale.

In view of the above, no ground is made out to interfere in the present appeal, and the same is hereby dismissed.
