This is a petition seeking a writ in the nature of mandamus for a direction to the respondent authorities for removal of illegal encroachment on the road in front of plots, situated in Uppal Southend, Sector 49, Sohna Road, Gurgaon, falling within the jurisdiction of Muncipal Corporation, Gurgaon.

Counsel for the petitioner submits that the petitioner will be satisfied in case a direction is issued to the respondents to consider representations Annexures P-6, P-7, P-8 and P-12, submitted before respondent No.3.

This petition is disposed of with a direction to Commissioner, Municipal Corporation, Gurgaon to consider the representation dated 28.12.2016 (Annexure P-12) by passing a speaking order on the basis of actual facts, existing on the spot. It will be appreciated in case the representation is considered within a period of three months after the receipt of a certified copy of the order. It will be the duty of the petitioner to communicate the order to the Commissioner, Municipal Commissioner, Gurgaon. In case the petitioner is entitled for any relief, the same may be granted, pursuant to the decision taken on the claim of the petitioner.
