By virtue of instant civil writ petition, preferred under Article 226/227 of the Constitution of India, petitioner has sought issuance of a writ in the nature of Mandamus directing the respondents department to release the GPF amount with interest @ 12% per annum as she has been dismissed from service vide order dated 25.04.2017 after having been convicted in a criminal case.

Learned counsel for the petitioner submits that though petitioner served legal notice dated 05.05.2018 (P-3) upon the respondents but till date no conscious decision has been taken by them.

Learned counsel for the petitioner further submits that petitioner feels satisfied in case direction is issued to respondent(s) to decide aforesaid legal notice in a time bound manner.

Instant petition is disposed of with a direction to respondent(s) to consider the case of petitioner unfolded in legal notice (Annexure P-3) and to take a conscious decision in the light of judgment passed by Division Bench this Court in CWP No.6064 of 1998, titled as "Gurcharan Singh v. State of Punjab", decided on 20.11.1998, within a period of three months from the date of receipt of certified copy of this order.

However, if the petitioner still feels aggrieved against any of the order(s) passed by the concerned authorities, she shall be at liberty to have recourse to the remedies available under law as well as to approach this Court.
